Biography
Mark is a partner in our Employment Practice and has over 7 years of specialised experience in respect of the employment law in Hong Kong.
Since joining the firm in 2018, Mark’s practice involves advising both employer and employees on a wide spectrum of employment law issues including recruitment, remuneration, termination, separation, post-termination restrictions, discrimination, harassment, drafting of handbooks and other HR-related policies/documents and other labour disputes.
Mark has considerable experience in contentious employment law and litigation in the Labour Tribunal, the District Court, the Court of First Instance and the Court of Appeal. These disputes concerned a diverse range of issues including unauthorised removal of company, claim of significant bonuses, negligent/fraudulent conduct at work and wrongful termination of employment.
Leveraging his prior experience as an in-house counsel at the Equal Opportunities Commission of Hong Kong, Mark regularly advises clients on discrimination and harassment issues under the Anti-Discrimination Ordinances and conducts large scale internal training for employers in this respect. He has developed and expanded this expertise into conducting and handling internal investigations by employers into potential misconduct and serious breaches of employment contracts by employees.
Mark is focused on delivering strategic and pragmatic advice to clients in different settings. He is also committed to devoting his time to pro-bono work in the community by participating in the various committees of the Law Society of Hong Kong and providing free consultation to those in need through referral by non-government organisations.
Biography
- Assisted the plaintiff in successfully obtaining summary judgment in a landmark Court of Appeal case against GF Capital (Hong Kong) Ltd [2020] HKCA 663 in relation to the payment of a guaranteed bonus.
- Assisted a senior executive of a multinational equity fund in successfully striking out a claim in the High Court brought by his employer seeking relief to assist in the Cayman Islands proceedings.
- Assisted a leading brokerage company in successfully resisting an application in the High Court for the determination of questions of law or construction under Order 14A in relation to the interpretation of a sign-on bonus clause in an employment contract.
- Assisted a leading insurance loss adjusting service provider in relation to proceedings in the High Court seeking a ‘springboard’ injunction and other relief relating to the removal of confidential information after a team departure.
- Conducted internal investigations for sexual harassment complaints for an international financial institution and assisted in the successful conciliation of the complaints lodged with the Equal Opportunities Commission.
- Assisted in a large-scale due diligence process concerning Hong Kong employment issues.
- Assisted in advising a leading real estate company in revising employment contracts and other employment-related policies.
- Assisted in advising a leading construction company in revising its bonus scheme for employees.
- Assisted a leading investment bank in revising restrictive covenants and template employment contracts of Hong Kong employees.
- Assisted a multinational food chain in relation to a large-scale transfer of employees
