Tanner De Witt’s family lawyers attend HKFLA talk on reciprocal enforcement of judgements between Hong Kong and the Mainland

On 15 June 2022, members of Tanner De Witt’s Family Law Department attended a talk on “Reciprocal Recognition and Enforcement of Mainland and Hong Kong Judgments in Matrimonial and Family Cases” organised by the Hong Kong Family Law Association (“HKFLA”). The talk was presented by a panel of experienced family law practitioners, including Ms. Corinne Remedios, Mr. Dennis Ho, Mr. Jeremy Chan and Ms. Ningning Zhao.

The talk provided an opportunity for lawyers and associated members in the industry to exchange insights, and explore current cross-border matrimonial issues between Hong Kong and the Mainland. Corinne and Jeremy illustrated the difference in the family law regimes between the two jurisdictions, and addressed some of the historical difficulties in enforcing judgments and orders made by Mainland courts in Hong Kong and vice versa. The panel later had a detailed discussion on the implication of the Mainland Judgments in Matrimonial and Family Cases (Reciprocal Recognition and Enforcement) Ordinance (Cap. 639) and its corresponding Rules (Cap. 639A), which came into effect in February 2022, in the two jurisdictions. The evening concluded with a Q&A session where practitioners exchanged their views on unsettled points of law awaiting to be clarified by the Hong Kong and the Mainland courts.
