Legal update: Divorce In Hong Kong – Accessing Information Offshore

Tanner De Witt Solicitors’ Litigation and Private Client team, led by Hong Kong lawyer Mark Side, will be attending a talk on divorce by the Hong Kong Family Law Association tomorrow evening. The presentation, titled “Accessing Information Offshore In Support Of Hong Kong Divorce Proceedings” will be hosted by Ian Mann, Head of Litigation, Restructuring & Insolvency – Hong Kong, at Harney Westwood & Riegels. The talk will deal with financial remedy proceedings connected to a divorce in Hong Kong where assets may be located in the BVI or Cayman Islands. Ian Mann will consider how the BVI and Cayman asset tracing and Court ordered pre-action discovery of third party respondents can assist in following and tracing property that ought properly to be brought into the matrimonial estate for distribution. He will also explore the process of swelling the marital estate to improve the overall award given by a divorce court. A discussion of various forms of relief to the proceedings will also be included, followed by a questions and answers session.
