Over the years, this has been enhanced by various reciprocal arrangements between the two jurisdictions.<\/p>\n<p><strong>A new regime on reciprocal enforcement of judgments is expected to come into operation in 2023<\/strong><\/p>\n<p>In October 2022, the Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance (\u201cthe Ordinance\u201d) was passed. The Ordinance, once it comes into effect (expected to be in the middle of 2023), will give rise to a new cross-border enforcement regime which supersedes the existing regime (\u201cthe Existing Regime\u201d). The New Regime is designed to apply to judgments made on or after the commencement date of the Ordinance and is anticipated to significantly expand the scope of reciprocal enforcement of Mainland court judgments in Hong Kong and vice versa.<\/p>\n<p>The New Regime will enable civil and commercial judgments rendered by the Mainland courts to be enforced in Hong Kong by way of a streamlined registration procedure.<\/p>\n<p><strong>Key changes under the New Regime<\/strong><\/p>\n<p>As regards enforcement of Mainland judgements in Hong Kong, the following is a brief comparison of the key differences between the Existing Regime and the New Regime.<\/p>\n<figure class=\"wp-block-image size-full is-resized\"><\/figure>\n<p>\u00a0<\/p>\n<\/div>\n<\/div>\n<\/div>\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"602\" height=\"649\" src=\"https:\/\/www.tannerdewitt.com\/wp-content\/uploads\/2023\/05\/image.png\" alt=\"\" class=\"wp-image-31468\" srcset=\"https:\/\/www.tannerdewitt.com\/wp-content\/uploads\/2023\/05\/image.png 602w, https:\/\/www.tannerdewitt.com\/wp-content\/uploads\/2023\/05\/image-278x300.png 278w\" sizes=\"auto, (max-width: 602px) 100vw, 602px\" \/><\/figure>\n\n\n<p><strong>Registration and enforcement of Mainland judgments in Hong Kong<\/strong><\/p>\n<p>A judgment creditor with an effective Mainland judgment may make an application to the Court of First Instance (\u201cCFI\u201d) in Hong Kong for a registration order on an ex parte basis.
