Her conduct involved over 100 defamatory, degrading, and abusive messages and social\u2011media posts targeting the Husband and his family.<\/p>\n<p id=\"ember66\" class=\"ember-view reader-text-block__paragraph\">The Court imposed 3 months\u2019 imprisonment, but suspended it for 24 months, conditional on strict compliance with her non\u2011molestation undertaking.<\/p>\n<p id=\"ember67\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p>\n<p id=\"ember68\" class=\"ember-view reader-text-block__paragraph\">While imprisonment in contempt cases is often treated as a last resort, Hong Kong courts may suspend sentences to secure future compliance with injunctions and protective orders<\/p>\n<p id=\"ember69\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p>\n<p id=\"ember70\" class=\"ember-view reader-text-block__paragraph\"><strong>Round Two \u2013 Immediate Imprisonment + HK$1Mn Cost<\/strong><\/p>\n<p id=\"ember71\" class=\"ember-view reader-text-block__paragraph\">Despite the suspended sentence, evidence showed the Wife continued to post more than 114 new offending posts from her social\u2011media accounts. She denied responsibility and alleged hacking, but provided no evidence of unauthorised access to her social media account.<\/p>\n<p id=\"ember72\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p>\n<p id=\"ember73\" class=\"ember-view reader-text-block__paragraph\">She further argued she had been \u201creverse discriminated\u201d against for being a Hong Kong solicitor. The Court found this argument irrelevant, self\u2011contradictory, and unviable.<\/p>\n<p id=\"ember74\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p>\n<p id=\"ember75\" class=\"ember-view reader-text-block__paragraph\"><strong>The Court\u2019s Key Findings (Balance of Probabilities Standard):<\/strong><\/p>\n<ul>\n<li>The <strong>volume, content, and tone<\/strong> of the posts were consistent with her prior conduct.<\/li>\n<li>She offered <strong>no credible evidence<\/strong> of hacking, password compromise, or outsider involvement.<\/li>\n<li>As a <strong>solicitor<\/strong>, she was expected to understand the seriousness of undertakings and Court orders.<\/li>\n<li>Her conduct reflected <strong>wilful and unremorseful<\/strong> continuation of contempt shortly after sentencing.<\/li>\n<\/ul>\n<p id=\"ember77\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p>\n<p id=\"ember78\" class=\"ember-view reader-text-block__paragraph\"><strong>The Outcome: <\/strong>The Court activated the original <strong>3\u2011month imprisonment<\/strong> and ordered her to <strong>pay HK$964,754<\/strong> in indemnity costs<\/p>\n<p id=\"ember79\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p>\n<p id=\"ember80\" class=\"ember-view reader-text-block__paragraph\"><strong>Key Takeaways for Hong Kong Family Law and Enforcement<\/strong><\/p>\n<p id=\"ember81\" class=\"ember-view reader-text-block__paragraph\">This new case reinforces the core themes of last week\u2019s article:<\/p>\n<ol>\n<li><strong>Committal orders are real tools of enforcement<\/strong> \u2014 They may be imposed, and suspended.
