That application was <a class=\"DZHnnrAbXeVuiFkPBfBjGXNSqtJxMHMIQUhc \" tabindex=\"0\" href=\"https:\/\/legalref.judiciary.hk\/lrs\/common\/search\/search_result_detail_frame.jsp?DIS=172066&amp;QS=%2B%7C%28cacv86%2F2024%29&amp;TP=JU\" target=\"_self\" data-test-app-aware-link=\"\" rel=\"noopener\">dismissed<\/a> on 3 September 2025.<\/p>\n<p id=\"ember1204\" class=\"ember-view reader-text-block__paragraph\">In refusing leave, the CA made clear that none of the proposed questions for determination by the CFA met the requisite threshold: they either did not arise from the CA\u2019s judgment in May 2024, raised no issues of great general or public importance, or were simply not reasonably arguable so as to justify a further appeal.<\/p>\n<p id=\"ember1205\" class=\"ember-view reader-text-block__paragraph\"><strong>CFA Dismisses Final Application<\/strong><\/p>\n<p id=\"ember1206\" class=\"ember-view reader-text-block__paragraph\">The same two defendants made a final attempt to pursue an appeal to the CFA. The application was heard by the Appeal Committee (The Honourable Mr. Justice Ribeiro, The Honourable Mr. Justice Fok and The Honourable Mr. Justice Lam) of the CFA on 28 January 2026 and was unequivocally dismissed at the conclusion of the hearing.<\/p>\n<p id=\"ember1207\" class=\"ember-view reader-text-block__paragraph\">In its <a class=\"DZHnnrAbXeVuiFkPBfBjGXNSqtJxMHMIQUhc \" tabindex=\"0\" href=\"https:\/\/legalref.judiciary.hk\/lrs\/common\/search\/search_result_detail_frame.jsp?DIS=177300&amp;QS=%2B%7C%28famv143%2F2025%29&amp;TP=JU\" target=\"_self\" data-test-app-aware-link=\"\" rel=\"noopener\">Reasons for Determination<\/a> handed down on 12 February 2026, the CFA held that the CFI\u2019s finding that the purported sale of GCBC\u2019s Hong Kong subsidiaries was backdated was \u201c<em>unimpeachable<\/em>\u201d. The CFA further endorsed the CA\u2019s reasons for refusing leave and confirmed that none of the defendants\u2019 points are reasonably arguable.<\/p>\n<p id=\"ember1208\" class=\"ember-view reader-text-block__paragraph\"><strong>Conclusion<\/strong><\/p>\n<p id=\"ember1209\" class=\"ember-view reader-text-block__paragraph\">The preliminary issues saga has now reached a final and decisive end.
