This is often referred to as the \u201c<em>4-18 requirement<\/em>\u201d.<\/p>\n<p>All employees covered by the EO irrespective of their work hours are entitled to basic EO protections.&nbsp; These basic protections include:<\/p>\n<ul class=\"wp-block-list\">\n<li>Payment of wages (sections 23 \u2013 25);<\/li>\n<li>Restrictions on wage deductions (section 32); and<\/li>\n<li>Statutory holidays (section 39).<\/li>\n<\/ul>\n<p>However, employees under a continuous contract are also entitled to additional statutory benefits and protections under the EO.&nbsp; They include:<\/p>\n<ul class=\"wp-block-list\">\n<li>Maternity and paternity leave (sections 12 and 15E);<\/li>\n<li>Rest days (section 17);<\/li>\n<li>Severance payment (section 31B);<\/li>\n<li>Long service payment (section 31R).<\/li>\n<li>Sickness allowance (section 33);<\/li>\n<li>Holiday pay (section 40); and<\/li>\n<li>Paid annual leave (section 41AA).<\/li>\n<\/ul>\n<p>(Collectively, \u201c<strong>Statutory Benefits<\/strong>\u201d).<\/p>\n<p>As such, under the existing provisions of the EO, any employees who work less than the 18-hour weekly requirement within any week of the given 4 weeks will not be entitled to Statutory Benefits.<\/p>\n<p><strong><em>Amendments<\/em><\/strong><\/p>\n<p>The Bill will relax the regime and make it easier for employees to qualify for the Statutory Benefits and protections applicable to employees who are on a \u201ccontinuous contract\u201d under the EO.<\/p>\n<p>In short, the Bill seeks to:<\/p>\n<p>(i) lower the weekly working hours threshold from 18 hours to 17 hours;&nbsp;<strong>and<\/strong><\/p>\n<p>(ii) provide an alternative of using the aggregate working hours of 18 hours in each of 4 consecutive weeks as the qualifying threshold, and allow an aggregate of 68 working hours or more, within a 4 week period, to qualify an employee as working under a \u201c<em>continuous contract<\/em>\u201d.<\/p>\n<p>The new alternative will assist employees with variable hours and whose working hours occasionally fall below the weekly threshold, to qualify them for the Statutory Benefits.<\/p>\n<p><strong><em>Potential impact<\/em><\/strong><\/p>\n<p>Currently, the work arrangements for some of employees are that they work less than the \u201ccontinuous contract\u201d threshold so that they are not entitled to Statutory Benefits.&nbsp;
