Russell specialises in employment, commercial litigation and insolvency and restructuring.
On the employment side, Russell acts for both employers and employees, with particular emphasis on high-value employment disputes in the financial sector. He advises on all aspects of employment law, termination entitlements, post-termination restrictions, bonuses, discrimination, drafting employment contracts, handbooks and other HR related documentation as well as health and safety matters.
On insolvency matters Russell acts for liquidators in numerous and high-profile liquidations in Hong Kong, including liquidations of leading dotcom companies, schemes of arrangement in substantial debt restructurings and advising creditors, receivers and claimants. Russell also acts in disputed winding-up and bankruptcy proceedings and advises on asset protection, bonds and guarantees, and proprietary claims both generally and in a construction industry context.
Russell is actively involved in all aspects of litigation advice and procedures relating to: proceedings to trial, summary judgment and seeking and opposing injunctive relief, including the enforcement of post-termination restrictions by injunctions; liquidation and bankruptcy proceedings, international litigation and jurisdictional disputes and Magistrate Court proceedings. He is also an accredited mediator.
He advises and acts in disputes on insurance and subrogation claims; joint venture terminations; landlord and tenant disputes involving possession, forfeiture, and distraint; debt collection, professional negligence, including surveyors/designers; international trade/sale of goods, and contractual commercial disputes.
- Advising liquidators in the first winding up of a leading dotcom in Hong Kong.
- Advising the Company in promoting a Scheme of Arrangement as part of S.E. Asia's largest debt restructuring.
- Acting for the petitioning creditor for a winding-up Order in HK of one of the first PRC "ITICS".
- Acting for the employee in one of the few reported cases on bonuses/end-of-year payments, Peter Rice v. Baring Securities (Hong Kong) Ltd, 1997 1 HKC, and on discretionary bonuses in Vanessa Gibson v. Nomura Hong Kong Ltd.
