Lincoln advises on all matters related to employment including discrimination, employee competition and poaching issues, protection of confidential information, drafting and reviewing employment documentation and policies, terminations and redundancies, occupational health and safety, and privacy-related matters. Representative Matters
- Advising a major international financial institution on restructuring its compensation and benefit structures and its implemention.
- Defending a major financial institution in relation to multiple bonus payment disputes.
- Advising employers and employees with respect to wrongful (summary dismissal) and unlawful termination (termination of pregnant employees other than for cause) claims before the Labour Tribunal.
- Representing employers and employees with respect to non competition and confidentiality obligations and claims for breach of such obligations.
- Reviewing employee handbooks for a large multinational corporation across the Asia Pacific region and liaising with local counsel to ensure compliance with local laws.
- Drafting and reviewing employment contracts, confidentiality agreements, settlement agreements, termination notices, policies and procedures, bonus plans, and all other employment-related documentation on behalf of both employers and employees.
- Advising employers and employees with respect to Hong Kong anti-discrimination legislation.
- Dealing with personal data and privacy issues and reviewing and drafting policies concerning the Personal Data (Privacy) Ordinance.
